These Terms and Conditions govern the use of the Olive Creek Wellness Retreat website and the booking and delivery of accommodation, residential wellness programmes, consultations, therapies, treatments and related services.

In these Terms and Conditions, “Olive Creek”, “we”, “our” and “us” refer to Olive Creek Wellness Retreat in Mauritius. “Guest”, “you” and “your” refer to the person making the booking and, where applicable, every person included in that booking.

By submitting a booking request, accepting a quotation, making payment or attending Olive Creek, you acknowledge that you have read and accepted these Terms and Conditions.

 

1. The Olive Creek Experience

Olive Creek provides private residential wellness retreats, accommodation, consultations, Ayurvedic therapies, complementary treatments, wellness services and personalised health support at its retreat in Mauritius.

Programmes vary in length, focus and intensity. Each programme may be adjusted according to the guest’s assessment, health information, practitioner recommendations, safety requirements and response during the stay.

Olive Creek is not a hospital, emergency department, inpatient psychiatric facility or medically managed withdrawal centre.

 

2. Booking Requests

Enquiries submitted through the website, email, telephone, WhatsApp, social media or an enquiry form are treated as booking requests only.

A booking request does not guarantee availability or create a confirmed reservation.

After receiving your request, Olive Creek may:

Review your preferred dates and accommodation;

Assess the programme or services you are considering;

Request further personal, medical or travel information;

Recommend a different programme, length of stay or accommodation option;

Provide a personalised quotation and payment instructions.

A reservation is confirmed only once the required payment has been received and Olive Creek has issued written confirmation.

 

3. Personalised Recommendations

Olive Creek programmes are not delivered as identical treatment schedules for every guest.

Recommendations may be based on consultations, health history, current medication, mobility, dietary requirements, personal goals and the professional judgement of the practitioners involved.

The services described on the website provide a general indication of the programme. They do not guarantee that every listed therapy, treatment or activity will be suitable for or provided to every guest.

Where a proposed treatment is considered unsuitable, it may be adapted, postponed, replaced or removed from the programme.

 

4. Quotations and Rates

Rates shown on the website are intended as general guidance and may change.

Your personalised quotation will confirm:

The programme or services selected;

The length and dates of your stay;

Your accommodation category;

The number of guests;

The principal inclusions;

The applicable price and currency;

The payment schedule;

Any specific booking conditions.

Unless otherwise stated, flights, travel insurance, visas, personal expenses and optional treatments are not included.

Rates for companions, shared accommodation, additional therapies, medical tests, specialist services and extended stays will be quoted separately where applicable.

The quotation accepted by the guest will take precedence over general pricing displayed elsewhere on the website.

 

5. Payment

Olive Creek may require full payment or a deposit to confirm a reservation. The amount and due date will be stated in your quotation or booking communication.

Payment may be made through an approved secure payment link, bank transfer or another method authorised by Olive Creek.

Any bank charges, foreign-exchange costs or payment-provider fees charged to the guest are the guest’s responsibility unless stated otherwise.

A booking request may be released without further notice if payment is not received within the communicated timeframe.

Guests should not send payment to bank details or payment links received from an unfamiliar source. Any unexpected change in payment instructions should be verified directly with Olive Creek before payment is made.

 

6. Arrival and Delivery of Services

Services are delivered at Olive Creek in Mauritius from the confirmed arrival date and according to the booking confirmation and personalised programme.

Guests must provide accurate arrival information and inform Olive Creek as soon as possible of delays or changes.

The delivery of therapies, consultations and activities remains subject to practitioner availability, guest suitability, health considerations and reasonable operational changes.

Check-in, check-out and transfer arrangements will be confirmed before arrival.

 

7. Health and Medical Information

Guests are responsible for providing complete and accurate information about matters that may affect their stay or treatment, including:

Existing medical or psychological conditions;

Recent surgery, illness, injury or hospital treatment;

Current prescription and non-prescription medication;

Allergies and intolerances;

Pregnancy or possible pregnancy;

Mobility limitations;

Dietary or religious requirements;

Any professional care currently being received.

Olive Creek may request medical reports, test results, discharge instructions or written clearance from a treating practitioner before accepting or continuing a booking.

Failure to disclose relevant information may affect Olive Creek’s ability to provide services safely. Where material information has been withheld, Olive Creek may adapt, suspend or terminate the guest’s programme without a refund for services already reserved or delivered.

 

8. Medication

Guests must bring enough prescribed medication for the full duration of their stay and continue taking it according to the instructions of the healthcare professional responsible for their care.

Guests must not stop, reduce or alter prescribed medication based solely on participation in an Olive Creek programme.

Assistance with storing, administering or managing medication must be discussed and agreed in writing before arrival. It should not be assumed to form part of a standard residential programme.

 

9. Programme Changes

Olive Creek may make reasonable changes to a programme where necessary because of:

Medical or therapeutic considerations;

Guest safety or wellbeing;

The guest’s response to treatment;

Practitioner availability;

Weather conditions;

Maintenance or operational requirements;

Circumstances outside Olive Creek’s reasonable control.

Where possible, Olive Creek will provide a suitable alternative of comparable purpose or value.

Optional or additional services will not be added to a guest’s account without prior discussion and approval.

 

10. Guest Cancellations

Unless different conditions are stated in the accepted quotation, payments made towards a confirmed booking are non-refundable when the guest cancels.

This reflects the advance allocation of accommodation, practitioner time, programme planning and other resources required to prepare for a personalised stay.

Cancellation requests must be submitted in writing to:

The date on which Olive Creek receives the written notice will be treated as the cancellation date.

Nothing in this section limits any rights that cannot lawfully be excluded.

 

11. Rescheduling and Credit Vouchers

Where a guest cannot attend, Olive Creek may, at its discretion, allow the booking to be moved or convert some or all of the amount paid into a credit voucher.

Any credit or rescheduling arrangement will be confirmed in writing and may be subject to:

Availability;

Programme and practitioner scheduling;

A stated validity period;

Seasonal or future rate differences;

Changes to accommodation or services;

An administration or rebooking charge where applicable.

A credit voucher cannot be exchanged for cash and is not refundable.

Where future rates are higher, the guest will be responsible for paying the difference before the revised booking is confirmed.

Approval of one date change does not create an automatic right to further changes.

 

12. Late Arrival and No-Show

A guest who does not arrive on the confirmed date and has not given written notice may be treated as a no-show.

A no-show may result in cancellation of the reservation and forfeiture of all amounts paid.

A late arrival does not automatically extend the departure date or entitle the guest to a refund, credit or replacement for missed accommodation, meals, consultations or therapies.

Olive Creek will make reasonable efforts to adjust the remaining programme where possible.

 

13. Early Departure

A guest who chooses to leave before the confirmed departure date will not normally receive a refund or credit for unused:

Accommodation;

Meals;

Consultations;

Treatments;

Activities;

Programme services.

Where a guest leaves because of a medical situation, any alternative arrangement or discretionary credit will be considered individually.

 

14. Cancellation or Changes by Olive Creek

Olive Creek may need to cancel, postpone or materially change a booking because of safety concerns, operational circumstances, practitioner unavailability or events outside its reasonable control.

Where Olive Creek cancels a confirmed booking for reasons within its control and cannot provide a suitable alternative, the guest may choose between:

Moving the amount paid to an agreed future booking; or

Receiving a refund for the affected services that Olive Creek is unable to provide.

Olive Creek will not be responsible for separate expenses such as flights, visas, insurance, onward accommodation or other travel arrangements. Guests are strongly encouraged to purchase suitable travel insurance.

 

15. Travel and Transfers

Guests are responsible for arranging and confirming:

Flights and other transport;

Passports and travel documents;

Visa and immigration requirements;

Travel and medical insurance;

Any vaccinations or health documentation required for travel.

Airport transfers may be arranged on request and may either be included or charged separately, depending on the confirmed booking.

Olive Creek is not responsible for airline cancellations, delayed or missed flights, denied entry, visa difficulties, baggage disruption or changes to government travel requirements.

 

16. Travel Insurance

Guests should obtain comprehensive travel insurance as soon as their booking is confirmed.

Appropriate cover should be considered for:

Booking cancellation or interruption;

Medical treatment abroad;

Emergency transport or evacuation;

Repatriation;

Flight disruption;

Lost or delayed baggage;

Activities planned before, during or after the retreat.

It is the guest’s responsibility to understand the policy conditions and confirm that the selected programme and any existing medical conditions are appropriately covered.

 

17. Companions and Additional Guests

A companion may share accommodation or take part in a separate programme only where this has been agreed and included in the booking confirmation.

The primary guest is responsible for ensuring that all accompanying guests understand and comply with these Terms and Conditions.

Any additional accommodation, meals, therapies or services requested for a companion may incur additional charges.

 

18. Guest Conduct

Guests are expected to treat other guests, team members, practitioners and the retreat property with respect.

Olive Creek may suspend or terminate a stay where a guest’s behaviour:

Places their own or another person’s safety at risk;

Is abusive, threatening or seriously disruptive;

Causes deliberate damage;

Interferes materially with another guest’s experience;

Involves unlawful conduct;

Prevents the team from providing appropriate care.

Where a stay is terminated because of serious guest misconduct, no refund will ordinarily be provided.

Guests may be held responsible for deliberate or negligent damage caused to rooms, facilities, equipment or other property.

 

19. Wellness and Medical Disclaimer

Olive Creek provides personalised wellness, therapeutic, integrative and, where specifically agreed, medical support services.

Individual responses differ, and no particular physical, emotional, weight-related, detoxification, pain-management or medical result is guaranteed.

Information on the website is provided for general guidance and does not constitute a diagnosis or personalised medical advice.

Participation in a programme does not replace necessary treatment from a doctor, specialist, psychologist, psychiatrist, physiotherapist or other qualified healthcare professional.

 

20. Emergencies and Unsuitable Conditions

Olive Creek is not equipped to manage medical emergencies, an acute psychiatric crisis, severe withdrawal symptoms or unstable conditions requiring hospital treatment.

Guests experiencing an emergency should contact the appropriate emergency or hospital service.

Olive Creek may decline or discontinue a programme if it reasonably believes that the guest requires a different level of care.

Where appropriate, the team may recommend assessment or treatment by another healthcare provider.

 

21. Personal Belongings

Guests remain responsible for their personal belongings, travel documents, money and valuables.

Olive Creek is not responsible for loss, theft or damage unless directly caused by its negligence.

Valuable items should not be left unattended, and any available secure-storage arrangements should be discussed with the team.

 

22. Photography and Privacy

Olive Creek respects the privacy of its guests.

Guests may not photograph, film or record another guest, consultation or treatment without clear permission.

Olive Creek will not use a guest’s photograph, name, testimonial or personal story for marketing without appropriate permission.

Personal information is handled in accordance with the Olive Creek Privacy Policy and applicable data-protection requirements.

 

23. Website Information

Olive Creek takes reasonable care to keep website information accurate and current. However, programme descriptions, rates, team information, photographs and facilities may change.

Images are illustrative and may not show the exact room, treatment, meal or programme available for a particular booking.

Website content should not be relied upon as a substitute for the personalised quotation and written booking confirmation.

 

24. Intellectual Property

The Olive Creek name, logo, website design, text, photographs, videos, programme material and other original content are owned by or licensed to Olive Creek.

Content may not be copied, reproduced, republished, distributed or used commercially without prior written permission.

Guests may download or print reasonable extracts for personal, non-commercial use.

 

25. Personal Information

Olive Creek may collect and process personal information needed to:

Respond to enquiries;

Assess programme suitability;

Manage reservations and payments;

Provide accommodation, treatments and consultations;

Meet safety, legal and administrative obligations;

Communicate with guests about their booking.

Health information will be handled with particular care and shared only where reasonably necessary for the agreed service, subject to the Privacy Policy and applicable law.

 

26. Force Majeure

Olive Creek will not be liable for delays, changes or failure to provide services caused by circumstances beyond its reasonable control.

These may include:

Cyclones, floods, fires or other natural events;

Pandemics or public-health restrictions;

Government actions or travel restrictions;

Civil unrest or security incidents;

Transport or airline disruption;

Utility, telecommunications or infrastructure failure;

Events affecting the safety or operation of the retreat.

Olive Creek will make reasonable efforts to communicate with affected guests and offer an appropriate alternative, rescheduling arrangement or credit where possible.

Any refund will be considered according to the circumstances, services already supplied, irrecoverable costs and applicable law.

 

27. Limitation of Liability

To the extent permitted by law, Olive Creek will not be liable for indirect or consequential loss arising from a booking, cancellation, travel disruption or participation in a programme.

Nothing in these Terms and Conditions excludes or limits liability where doing so would be unlawful, including liability arising from fraud or negligence where it cannot legally be excluded.

Guests remain responsible for following professional advice, safety instructions and the agreed programme conditions.

 

28. Complaints

Concerns should be raised with the Olive Creek team as soon as possible during the stay so that there is a reasonable opportunity to address them.

Please include your name, booking details, the nature of the concern and the outcome you are seeking.

Olive Creek will review the complaint and respond within a reasonable timeframe.

 

29. Governing Law

These Terms and Conditions and any booking with Olive Creek are governed by the laws of the Republic of Mauritius.

Any dispute that cannot be resolved directly between the parties will be subject to the jurisdiction of the competent courts of Mauritius, unless applicable law requires otherwise.

 

30. Changes to These Terms

Olive Creek may update these Terms and Conditions when its services, booking practices or legal obligations change.

The version accepted when a booking is confirmed will generally apply to that booking, unless a later change is required by law or agreed in writing.
